LAST WILL AND TESTAMENT OF JAMES R. MAGGART I, James R. Maggart of Carroll County, Indiana, do make, publish and declare this written instrument to by my last will and testament and form as follows: I am the owner at the present time of two hundred eighty five acres of farm land located in Carroll County, Indiana, and have personal property to the amount of approximately twenty thousand dollars in bonds, notes and money, and in addition thereto farm machinery, grain on hands and live stock and I dispose of all my property, both real and personal, as follows, to wit:- ITEM 1:- It is my will that all just debts be paid by my executrix and executor hereinafter names, including expenses of my last sickness and burial and a proper marker at my grave as soon after my decease as convenient and possible. ITEM 2:- I give and devise to my son, James O. Maggart, the following described real estate in Carroll County, Indiana, to wit:- The east half of the southwest quarter of Section 7, in township 23 north, range one east, the same to have and to hold and during the period of his natural life, and at his death said real estate shall go to and I hereby give and devise the same to the children of my said son, it being my intention that the children of my said son now living shall share said real estate with children hereafter born to him share and share alike and in the event any of said children should die before the decease of my said son, leaving a child or children surviving, then the descendants of such deceased child shall take the share their parent or parents would have taken if living. ITEM 3:- I give and devise to my daughter Elgin Barnard the following described real estate in Carroll County, in the State of Indiana, to wit:- The west half of the southwest quarter of Section 7, in township 23 north, range one east, the same to have and to hold for and during the period of her natural life, and at her death said real estate shall go to and I hereby give and devise the sam to her children under the sam terms and conditions as set forth in the devise to my son, James O. Maggart, in Item two hereof. ITEM 4:- I give and devise to my daughter Devera Maggart, the following described real estate in Carroll County, in the State of Indiana, to wit:- The east half of the southeast quarter of Section 12, in township 23 north, range one east, the same to have and to hold for and during the period of her natural life, and in the event my said daughter should marry and at her death leave surviving her children then real estate shall go to such child or children under the same terms and conditions as set forth in the devise to my son James O. Maggart, in item two hereof. But in the event my said daughter, Devera, should never marry and should leave to child or children her surviving, then said real estate shall go to and I hereby give devise the same to my lawful heirs living at the time of my death. ITEM 5:- I give and devise to my daughter Ennie Speer the following described real estate in Carroll County, in the State of Indiana, to wit:- The south one half of the east half of the northwest quarter of Section 7, in township 23 north, range one east, also five acres off the east side of the south west quarter of the northwest quarter of Section 7, said township and range, the same to have and to hold for and during the period of her natural life, and at her death said real estate shall go to and I hereby give and devise the same to her children under the same terms and conditions as set forth in the devise to my son, James O. Maggart, in Item two hereof. ITEM 6:- I give and bequeath to my daughter, Nora Fellows, the sum of seven thousand dollars, the same to be her own absolute property. ITEM 7:- I give and bequeath to my daughter, Dorothy Pullen, the sum of seven thousand dollars, the same to be her own absolute property. ITEM 8:- All the rest and residue of my property, I give, will, bequeath and devise share and share alike to my three daughters, Elgie Barnard, Ennie Speer and Devera Maggart, the same to be their own absolute property. ITEM 9:- I nominate and appoint my daughter, Nora and my son, James O. joint executrix and executor of this my last will and testament and direct that they be each paid the sum of one hundred dollars for their services in the settlement of my estate.
